What's An Insolvency Practitioner?
Insolvency is what's called when a person or a company has huge debts that can no longer keep up with, as these debts fall due. In this case, when the individual has no other options, he must take alternative measures than are treated under legal proceedings. When the person engages in these proceedings, he will need the help of the insolvency practitioner (IP).
An insolvency practitioner is a legal specialist who approaches financially problematic situations. He is basically the person one turns to for help when there are insolvency difficulties encountered.
For example, if it's the case of an IVA application (Individual Voluntary Agreement), then the applier may ask the assistance of the insolvency practitioner.
This professional will be in charge of looking over all the necessary legal paperwork of the debtor that will be next presented in front of the IVA creditors. The insolvency practitioner will work in the benefit of the client, until the IVA application is approved, as an IVA Nominee.
The work will include dealing with any collection creditors that may appear and other issues, with the IP displaying in the role of the debtor. The IVA Nominee must make a professional independent judgment on the debtor's financial evolution in order to validate and present this in the following creditors meeting.
After the creditors meeting, where they approve the Individual Voluntary Arrangement application, the role of the IP will change from the Nominee of the IVA to the IVA Supervisor. His following job will be to monitor the debtor's progress in successfully respecting the terms of the IVA contract, by working for the creditors.
The debtor will have to make his monthly repayments till the established deadline and generally respect the terms of the Individual Voluntary Arrangement contract (the monthly payments will be set as reasonable, to both the debtor and the creditors).
The IP will also make periodical check-ups on the debtor's current financial position, so everything is in place, according to the IVA agreement. Any mistakes or deviation from the agreed contract shall be presented to the creditors.
When hiring an insolvency practitioner, it's always recommended to do some research and visit a few websites (preferably governmental ones) that offer this type of legal advice and service. It is obvious that there have already been enough extreme difficulties that made someone go to such lengths to get here, so the last thing someone needs is an incapable IP.
By getting to know their options beforehand, people can carefully and efficiently choose a good legal representative that will help them make the right decisions concerning IVA applications. People should check the professional background and experience, testimonials from clients of the company, before making a rushed decision when choosing an insolvency practitioner.
The insolvency practitioner will be a key in an IVA application, as he will decide the outcome of the case. And finding a good IP is vital, as he will be able to solve any financial issues that may occur.
